These drugs or devices are developed, manufactured, sold and promoted by pharmaceutical companies and individuals suffer physical harm. This individual physical harm is what makes them different from “class actions”.
WRONGFUL DEATH
WRONGFUL DEATH cases are cases brought by the survivors or family members of someone that died. The person may have died from an accident, use of a defective product or prescription drug or medical device. These cases are limited by specific state law and statutes on a state by state basis. PRODUCT DEFECT LIABILITY cases involve claims against a manufacturer of a consumer product that causes injury. These are everyday products used by consumer that may have been defectively designed or manufactured leading to injuries or even death. The product itself may or may not have been subject to a “recall” or “market withdrawal“. Often such products remain available for sale and use by consumers despite alleged defects.
